Right of withdrawal and exclusion of right of withdrawal

Your right of withdrawal

You have the right to revoke this contract within fourteen days without statement of reasons. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods or, in the case of partial delivery, the last delivery, or - in the case of a service contract or a contract for the delivery of digital content that is not delivered on a physical data carrier - from the day on which the contract is concluded. To exercise the right to cancel,you must inform us (tonies GmbH, Oststraße 119, 40210 Düsseldorf, Germany, email: widerruf@tonies.com) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail).You can use the sample cancellation form attached, however, this is not mandatory. To comply with the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal prior to the end of the cancellation period.

If your cancellation relates to a contract for a bundle (our product sets, consisting of several Tonies products), the cancellation applies to the entire bundle. Cancellation of individual products from a bundle is not possible.

Consequences of withdrawal

If you cancel this contract, we are required to refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your cancellation of this contract. We will undertake this repayment using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. If your cancellation relates to a bundle, the entire bundle must be returned to us. The deadline is met if you send the goods before the end of the fourteen-day period. The direct costs of returning the goods will be borne by you. You only have to pay for any loss in value of the goods where this loss in value is the consequence of any handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

Premature expiry of the right of withdrawal.

Expiry of the right of cancellation for services. Your right of withdrawal in the case of a contract for the provision of services shall expire prematurely upon the complete provision of the service (e.g. the repair) if you have expressly agreed before the commencement of the provision that we commence the provision of the service before the expiry of the withdrawal period and have given your consent and at the same time confirmed your knowledge that your right of withdrawal shall expire upon complete performance of the contract by us.

Expiry of the right of cancellation for contracts for digital content. Your right of withdrawal expires prematurely in the case of a contract for the provision of digital content after you have started to download these or if we have commenced performance of the contract after you have expressly agreed that we may commence performance of the contract before the expiry of the withdrawal period, have confirmed your knowledge that your right of withdrawal expires as a result of your agreement with the commencement of performance of the contract and we have provided you with confirmation.

Return in case of withdrawal. You will receive the return label by e-mail after you have requested your return in our returns portal. To receive it, enter your order number and email address, select the goods and number of products to be returned and the reason for return (optional).

Voluntary take-back guarantee

Voluntary take-back guarantee.In addition to your statutory rights in the event of defects and independent of the aforementioned statutory right of revocation, each of which exists free of charge and is not restricted by this take-back guarantee, all goods purchased from us may be returned to us within 60 days of receipt of the goods under our voluntary take-back guarantee, provided the goods are complete and in unused and undamaged condition ("take-back guarantee").

Bundles (our product sets consisting of several Tonie products) can only be returned in their entirety. The return of individual items from a bundle is not possible.

Refund modalities and processing of the return

If you return goods in accordance with this voluntary take-back guarantee, we will refund your purchase price but not the shipping costs of your original purchase. You will receive the return label by email after you have requested the return in our returns portal. To receive this, enter your order number and email address, select the goods and number of products to be returned and the reason for return (optional). Returns for deliveries within Germany may only be made with the same shipping provider with which the delivery was made. Only use the return label provided by us for this purpose. If you fail to follow these instructions, you will have to pay the return costs yourself, including within Germany. If you have any questions, please do not hesitate to contact our customer service.

Guarantor. Your guarantor is tonies GmbH, Oststraße 119, 40210 Düsseldorf, Germany.

Exclusion of further guarantees. We do not grant any guarantees beyond the take-back guarantee.
