Thank you for submitting a voice note to Today with tonies.

Please read the following terms carefully. By submitting your audio clip or message (the “Clip”), you confirm that you are the parent or legal guardian of the child featuring in the Clip and named below (your "Child") and that you agree to the terms set out in this document on behalf of yourself and your Child.

By submitting a Clip you confirm that your Child has been informed about the recording and has willingly agreed to take part. Clips should only be submitted where your Child has shown a clear willingness to be recorded and to have their message shared on the Today with tonies podcast.

When we refer to “you” we are referring to the parent or guardian who has submitted the Clip. When we refer to “we” or “us” we are referring to tonies UK Ltd, Causeway House, 1 Dane Street, Bishops Stortford, Hertfordshire, United Kingdom, CM23 3BT. We operate through our agency, Audio Always Limited, White, Media City Uk, Salford, England, M50 2NT (“Audio Always”) who are an independent production company producing our podcast.

1. You have submitted or will submit a Clip on behalf of your Child for possible inclusion in the podcast Today with tonies (“Podcast”). Not all submissions can be included, and there is no obligation on us to use any Clip.

2. You confirm that you have the authority to grant the rights set out below on behalf of your Child. You and your Child grant to us, Audio Always, and their production partners a licence to record, edit, copy, add to, adapt, reproduce, broadcast, publish, distribute, store, translate (including by dubbing it in foreign languages) and otherwise use the Clip, in whole or in part, in all media formats now known or later developed, in connection with the Podcast and related promotional activity. This licence is not limited by territory, is royalty-free (i.e. there is no fee payable by us for the recording) and is unrestricted.

3. Clips may be spoken, quoted or played back on the Podcast and will also be listened to by our staff and other third parties involved with the Podcast. As such, any Clip shared with us should be considered non-confidential.

4. You understand and agree that the Clip may be edited for length, clarity or suitability, that neither we nor Audio Always are obliged to include the Clip in the Podcast and that legally you and your Child waive any moral rights you or they may have in the Clip, to the extent permitted by law.

5. You agree that the Clip is provided by you and your Child without payment to either of you, and without liability (save as specifically set out in these terms), or acknowledgement to you or your Child.

6. Unless otherwise agreed in writing only your Child’s first name or a pseudonym will be used by us when the Clip is included in the Podcast. No precise location or identifying personal information will be shared by us on the Podcast. If use of your Child’s full name is ever proposed by either us or you, this will only occur with your separate, explicit consent.

7. You confirm, to the best of your knowledge and belief, that the Clip does not infringe the rights of any third party and the Clip is not defamatory, unlawful, or misleading. You confirm that the Clip does not contain any audio from any other individual besides you or your Child. If the Clip contains the audio of any other child (except for your Child) then you must ensure that the parent or legal guardian of that child has separately agreed to these terms in relation to that child’s contribution.

8. Neither we nor Audio Always shall be liable for any loss, damage or injury suffered by you or your Child in connection with the Clip, except where caused by our negligence.

9. You agree that you have read the Data Protection Information Sheet, available here.

10. Audio Always will receive and process personal information relevant to the Clip and this form, including parent or guardian contact details, in accordance with its privacy notice, available at: www.audioalways.com/privacy-notice. This information will be used only for editorial, production, safeguarding and compliance purposes.

11. Please also ensure you read the Audio Always safeguarding policy which sets out how we safeguard contributors, available at: Audio Always Safeguarding.

12. You may request that we take down your Clip at any time. Please email today@tonies.co.uk with this request.

13. The laws of England shall govern the terms of this form and you and we agree that the courts of England shall have exclusive jurisdiction to finally settle any disputes or claims arising from these terms.

14. By agreeing to these terms you consent to the processing of your Child’s Clip in accordance with the Data Protection Information Sheet.
