These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by participating all entrants will be deemed to have accepted and be bound by the terms and conditions. Winner: the winners, as selected by the Promoter, of this competition.
Open to those who are aged 18 years or over and are residents of the United Kingdom and Ireland only, excluding employees, and their immediate families and friends, of tonies, agents, third parties and/or any other persons professionally connected with the promotion or Promoter.
To enter the giveaway you must follow all the steps on our respective Instagram/Facebook post.
All entry comments must remain on the giveaway post for the full duration of the giveaway, and remain in place for 24 hours to enable draw to be undertaken.
For a ‘comment’ to be deemed a valid entry in the giveaway, it must be applied to the giveaway posts, in the context of following all the rules posed in the original post copy and these terms and conditions. Comments on shares or reposts of the original giveaway post will not be deemed eligible
Entrants of the giveaway must be registered users of Instagram or Facebook.
You must not set up multiple Instagram accounts in order to enter the giveaway more than once.
Entries are limited to one comment per person. Multiple entries could lead to exclusion at the Promoter’s discretion.
All entries including eventual winners permit the Promoter to use submitted details (including name) in any promotion and communications of the giveaway, including on tonies’ Instagram account(s), Facebook page(s) or any other social media channel, website and internal communications.
It is your choice to provide us with personal information. We will only collect personal information that you choose to provide. In some circumstances we may have to share your shared personal information with other parties, such as when we are satisfying the obligations of a contract with you, administering this competition or a transaction requested by you, or required by law.
Entrants publicity: entrants accept that the Promoter has the right, without additional payment or permission, to use their name submitted as entry to the competition for the purposes of announcing the winner(s) and for promotional purposes administrated in the UK & Ireland, inclusive social media channels and websites that are accessible globally.
By providing any personal information to us, you fully understand and clearly consent to the transfer of such personal information to, and the collection and processing of such information in, other countries or territories. Any such transfer and processing by us will be in accordance with our Privacy Policy. If you do not agree to these notices, please do not provide your personal details to us.
The prizes of this giveaway are as depicted in respective post.
No cash or other alternative prizes are available, unless deemed necessary by the Promoter and/or UK law and guidelines. The Promotor reserves the right to substitute similar alternatives of equal or greater value. The prize will only be made available to the winner themselves and is not transferable.
Winners will be randomly selected from all valid entries after the giveaway closes. The random selection will be undertaken by a computer process that produces verifiably random results. Data is entered by a human, before the computer process produces random results from this data. Draw will be undertaken at the Promoter’s discretion in accordance with UK law and guidelines. The Promoter will not enter in to discussion on this matter.
The winner will win one prize only.
The winner will be randomly selected after give away ends. The winner may be notified in one or all of the following ways:
An announcement via a comment on the giveaway post on Instagram or Facebook or an additional timeline post, this comment or post may tag the winner asking them to direct message tonies UK’s Instagram or Facebook account to provide further details including proof of age and address for their prize to be honoured.
Via direct replies to the winner’s comment on the original giveaway post, asking them to direct message tonies UK’s Instagram or Facebook to provide further details including proof of age and address for their prize to be honoured.
In the event that the winner refuses acceptance of their prize or, for whatever reason, cannot accept their prize, or if the Promoter is unable to make contact with the winner within two days of first/initial ‘winning’ notification, or any winner does not confirm their details for receipt of the prize within 48 hours of first/initial ‘winning’ notification, the Promoter reserves the right to re-draw the prize and award it to an alternative winner from all valid entries, or to award it to a back-up winner that was drawn during the original winner random draw, or to dismiss selecting a replacement winner.
Once contact has been made with the winner and contact and delivery details obtained by the Promoter, the winner will receive their prize after the official launch of the new tonies in August.
The Promoter accepts no responsibility for all submitted entries and public activity surrounding this giveaway.
Proof of submitting your entry is not proof of receipt of an entry by the Promoter.
The Promoter is not responsible for any entries that fail to be submitted for any technical, or other, reason whatsoever.
The Promoter reserves the right to not accept and moderate (including deleting) entries that are deemed late, incomplete, incorrectly submitted, prematurely removed, corrupted, misdirected, use vulgar and/or inappropriate language, entered in error, are altered, tampered with, make reference to inappropriate/sensitive activity and/or events.
The Promoter reserves the right to verify the eligibility of all entrants and to disqualify any entrant if they have reasonable grounds to believe the entrant has breached any of the terms and conditions.
By submitting your entry, you warrant and undertake that:
Your entry does not infringe any third-party rights.
Your entry does not infringe any intellectual property rights (excluding any intellectual property rights owned by or licensed to the Promoter), and you are the legal and beneficial owner of all intellectual property rights in your entry.
You have the right to grant the Promoter the permission and consents necessary to use your entry as set out in these terms and conditions.
Your entry does not contain any discriminatory, obscene, defamatory or otherwise objectionable material, nor anything which may reasonably be considered to be offensive (whether by image, gesture, statement or other material of any kind).
Your entry does not ‘troll’ or ‘spam’ the spirit of the competition and does not reference rival brands and competitors.
The Promoter reserves the right to remove any comment which they consider to be in breach of these terms and conditions.
The Promoter reserves the right to remove any comment which breaches the community standards put in place and upheld on the tonies UK Instagram or Facebook profile
The prize winner assumes all risks inherent to winning the offered prizes. The Promoter will not, to the fullest extent allowed by law, accept any responsibility for loss, injury or death suffered as a result of promotional participation or the acceptance/use of any prize, other than that caused by negligence or breach of duty of care by the Promoter.
The Promoter’s decisions in all promotional matters will be final and no correspondence shall be entered into.
By entering this promotion, all participants will be deemed to have accepted and will be bound by these terms and conditions.
The Promoter reserves the right to abort the giveaway at any given moment and to shorten, modify, suspend or cancel the giveaway in the event of unavoidable circumstances beyond the control of the promoter, without resulting in liability or any claim of damages.
The Promoter reserves the right to disqualify any participant or user that the Promoter reasonably believes (i) to have tampered with the operation of the giveaway and/or (ii) to be acting in violation of these terms & conditions.

Every Bing Tonie purchased between 24th - 27th May will be entered a prize draw. The winner will be chosen by a random generator of all order numbers. The winner will be contacted the following week by tonies UK to arrange a date for your family trip to Alton Towers.
Prizes can be redeemed by responding to the winning post from the Tonies official Social media pages on Facebook, Email and Instagram.

Prizes can only be used as stipulated, are not transferable to another individual and cannot be exchanged for cash or used in any other way. Sale of the Prizes for profit is prohibited. Prizes cannot be used in conjunction with any other offer or ticket. Prizes must be taken as a complete package. By accepting a prize, the winner agrees to release and hold harmless the Promoter and its subsidiaries, affiliates, suppliers, distributors, agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the promotion or receipt of, use or misuse of any prize.
The Released Parties are not responsible for:
any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Prize draw
technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software failures of any kind including any injury or damage to any person's computer account resulting from participating in this Prize draw.
unauthorized human intervention or human error which may occur in any part of the entry process or the process for allocating the prize(s);
technical or human error which may occur in the administration of the Prize draw or the processing of entries;
late, lost, undeliverable, damaged or stolen post; or
any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant's participation in the Prize Draw or receipt or use or misuse of any Prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Prize Draw if it is possible.
Nothing in this section shall exclude the Released Parties' liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability whose limitation is prohibited by law.
Use of a false name or address will result in disqualification.
Entries that are incomplete, illegible, altered, reconstructed, forged or tampered with, inaudible or indecipherable will not be valid and deemed void. [Photocopies of entries are not acceptable.]
All entries must be made directly by the person entering the Prize Draw.
Entries from agents, third parties, organised groups or entries automatically generated by computer or completed in bulk, will not be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with these terms and conditions.
No responsibility can be accepted for entries or claims that are not submitted on time or in full, lost, mislaid, damaged, or delayed via e-mail/phone, regardless of cause, including, but not limited to, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind, or corrupted webpages.
The winners and their companions are responsible for any expenses which may be incurred by the winners in claiming any prize.
Prizes are subject availability and to the individual attraction's terms and conditions.
In the event of circumstances outside its reasonable control, the Promoter reserves the right to void, suspend or cancel the [Prize Draw/Competition] where it becomes necessary to do so, or amend or alter the terms of the promotion at any time, but will always endeavour to minimise the effect on participants to avoid undue disappointment.
In the event of a prize being unavailable, the Promoter reserves the right to offer an alternative prize of equal or greater value.
The winner agrees to co-operate (and to procure the co-operation of his/her companions who share in the benefits of the prize) with any reasonable requests by the Promoter relating to any post-winning publicity; provided that Promoter shall comply with paragraph 41, for example it may only publish personal details in generic form e.g. John from London.
In so far as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any winners or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Statutory rights are not affected.
The attraction entry tickets can only be claimed and used by the prize winner and as stipulated. The tickets are non-transferable and not for resale. Any purported or attempted transfer or sale of or other misuse of the tickets will render them automatically void.
The Promoter's decision is final in relation to promotional matters and no correspondence or discussion will be entered into.
Size, height, weight, and age restrictions and medical warnings apply to certain rides and attractions. The attractions reserve the right to refuse entry and to close and/or alter all or any part of the facilities including closure of rides and/or attractions and removal of figures for technical, operational, health and safety or other reasons including overcapacity.
In the event of a discrepancy between these standard terms and conditions and the details in the promotional material, these terms shall prevail.
The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe:
there has been a breach of:
these terms and conditions;
any law; or
any instructions forming part of this promotion's entry requirements or otherwise;
a participant has gained unfair advantage in participating in the promotion or won using fraudulent means;
an entry infringes any right; or
the participant's conduct is contrary to the spirit or the intention of the Prize Draw
Except to the extent that the Promoter is prevented by law from doing so, a list of winners will be available on the Tonies social channels, Instagram, Facebook & Newsletter unless otherwise stated, after the close of the Prize Draw and for a period of 3 months, Only the first name, surname and county of the winners will be disclosed.
If any provision of these Terms and Conditions (or any part thereof) is held to be invalid or unenforceable, all remaining provisions (or part thereof) will remain in full force and effect.
Data Protection: Where you participate in a Prize Draw/Competition, your personal data shall be processed in accordance with our Privacy Statement available here [insert link]. By submitting an entry, the participant acknowledges that the processing of his/her personal data is necessary for the Promoter to fulfil its obligations to the participant in respect of the promotion and to enable you to enter the Prize Draw visit and use our Website and/or to claim any Prize you may win. You confirm and warrant that all data provided by you for these purposes are accurate. If the participant exercises his/her right to object to the processing of such personal data prior to the end of the Prize Draw, his/her participation may be cancelled.
